1 Notaries are also entitled to collect freely negotiated fees in return for services, provided that these services are not subject to the regulated tariff for notaries. In such cases, a fee agreement must be agreed with their client.
² This decree incorporates the principle of negotiated discounts after any fixed discounts granted by the notary have been applied. In actual fact, the discount rate mentioned in the second sentence of the sixth paragraph of Article L. 444-2 may be agreed between the professional and their client for fees exceeding a threshold of €200,000.
